Scope of these Terms
These Terms & Conditions apply to all orders placed through the Alierd online shop.
Different or additional terms from the customer do not apply unless we have agreed to them in writing.
By placing an order, the customer agrees to these Terms & Conditions.
Orders may only be placed by persons who have the legal capacity to enter into binding contracts.
Products & natural variation
We sell living plants. Plants are natural products and every plant is slightly different.
Product photos are representative examples. Each plant is unique and may differ in branching, shape, density, colour, flowering stage, leaf condition and overall appearance.
The delivered plant will correspond to the selected product and size as closely as reasonably possible, but natural variation is normal and is not usually considered a defect.
Plant sizes are approximate and may vary slightly because plants are living products. Unless otherwise stated, plant height is measured including the nursery container.
Plants are delivered according to their natural seasonal condition. Deciduous trees and shrubs may arrive without leaves during autumn, winter or early spring. Flowering plants may arrive before or after their flowering period. This is normal and is not considered a defect.
Small leaf imperfections, slight colour differences, minor shape variation, small broken twigs, seasonal leaf drop, old leaves, minor transport marks or natural variation within the stated size range are normal and are not usually considered defects.
Prices
All prices are shown in Swiss francs (CHF).
The price shown at the time of ordering applies. Delivery costs, if applicable, are shown during checkout before the order is completed.
We reserve the right to correct obvious pricing, stock, product information or technical errors.
Orders and contract conclusion
By placing an order, the customer submits a binding offer to buy the selected products.
After the order is placed, the customer receives an order confirmation by email. This confirms that we have received the order.
The sales contract is concluded when we accept the order. Acceptance may take place by confirming the order, processing the order, preparing the products, dispatching or delivering the products, or otherwise clearly accepting the order.
We may refuse or cancel an order if a product is unavailable, if there is an obvious pricing, stock or technical error, if payment is not completed, if fraud, misuse or payment irregularities are suspected, or if delivery is not possible under reasonable conditions.
If a product becomes unavailable after the order is placed, we will contact the customer and offer a suitable solution where possible. This may include a replacement product, a later delivery date, a partial refund, or cancellation of the affected item.
Order cancellation by the customer
The customer should contact us as soon as possible if they want to cancel an order.
Orders can usually be cancelled free of charge within 24 hours after placing the order, provided that the plants have not yet been prepared, reserved, moved from storage, loaded, scheduled for delivery or otherwise processed.
After this point, cancellation may no longer be possible, or we may deduct reasonable handling, preparation, storage, loading, delivery planning or other costs already incurred.
Because plants are living products and may be reserved or prepared specifically for an order, cancellation is not always possible once order processing has started.
Payment
Payment is made using the payment methods available at checkout.
The order will normally be processed after successful payment. We reserve the right to withhold delivery until payment has been received in full.
We reserve the right to refuse or cancel orders where fraud, misuse, payment irregularities, chargeback risk or unauthorised payment activity is suspected.
Refunds, where applicable, are made to the original payment method where possible.
Delivery
Detailed delivery procedures, receiving instructions, packaging information, unattended delivery conditions and delivery-related FAQs are described on our Delivery & Returns page.
The customer is responsible for providing complete and accurate delivery information and for making sure that delivery can be completed at the agreed or notified delivery location.
Plants should be unpacked, checked and watered if needed as soon as possible after delivery. The customer is responsible for suitable handling, watering, storage and planting conditions after delivery.
Plants are intentionally delivered with slightly reduced moisture. This helps avoid unnecessary mess, excess weight and handling issues during transport.
Delivery times and availability
We will notify the customer in advance about the planned delivery date or delivery window.
Plants are usually delivered within 5–15 working days after order confirmation, depending on availability and suitable weather conditions.
The exact delivery date also depends on plant preparation and route planning.
Working days are Monday to Friday, excluding Swiss public holidays.
Delivery dates and delivery times are estimates and are not guaranteed unless we have explicitly agreed to a guaranteed delivery date in writing.
Delivery dates are based on our available delivery schedule and route planning. Especially at the beginning, delivery may be limited to one or two allocated delivery days, and fully flexible customer-selected delivery dates cannot be guaranteed.
If the proposed delivery date does not work for the customer, the customer must contact us as soon as possible. We will try to offer another available delivery date, but this depends on our delivery capacity and route planning.
During periods of strong frost, heat, storms, hail or other unsuitable weather, we may postpone delivery to protect plant quality. If delivery needs to be delayed because of weather conditions, we will inform the customer as soon as reasonably possible.
Depending on plant size, availability and delivery planning, an order may arrive in more than one delivery. If tracking information is available, we will provide it after dispatch. For deliveries handled by our own vehicle or route planning, tracking may not always be available.
Delivery address and access
The customer is responsible for providing a correct and complete delivery address before placing the order.
We are not responsible for delays, failed delivery attempts or plant quality issues caused by incorrect or incomplete delivery information.
For larger plants or larger orders, the customer must make sure that the delivery location is accessible for our vehicle and that there is enough space to unload the plants safely.
Additional costs caused by incorrect or incomplete delivery information, failed delivery attempts, inaccessible delivery locations or necessary redelivery may be charged to the customer or deducted from any refund where applicable.
Risk transfer
Risk for the products passes to the customer when the products are delivered to the agreed delivery location.
If the customer requests unattended delivery, risk passes to the customer when the plants are left at the instructed delivery location.
After risk has passed, the customer is responsible for protecting the plants from theft, weather, heat, frost, wind, animals, lack of watering, unsuitable storage, delayed unpacking or other conditions outside our control.
Unattended delivery
We recommend signed delivery whenever possible.
If the customer requests delivery without a signature, they must provide clear delivery instructions before the delivery date. For example, the customer should state exactly where the plants should be left.
If unattended delivery is requested, the customer accepts the risks connected with leaving living plants outside after delivery. This includes theft, weather exposure, heat, frost, hail, wind, heavy rain, animals, unsuitable placement, or damage caused by delayed unpacking or watering.
If no unattended delivery instructions are provided and signed delivery is not possible because nobody is available at the delivery address, the delivery may be treated as a failed delivery attempt.
Failed delivery attempts
If signed delivery is planned and nobody is available at the delivery address, we may attempt redelivery on another available delivery date.
Failed delivery attempts may result in additional delivery, handling or storage fees, especially if the plants have already been prepared, loaded, transported or scheduled for delivery.
If we need to contact the customer regarding delivery, the customer should respond as quickly as possible to avoid unnecessary stress to the plants.
If delivery fails more than once and the customer does not respond to our communication, we may place the order on hold. If we receive no response within 7 days, we may cancel the order.
In case of cancellation after failed delivery attempts or lack of customer response, we may deduct delivery costs, failed delivery costs, handling costs, storage costs and any loss in plant value from the refund.
Because plants are living products, long storage after failed delivery may affect their condition. If the plant can no longer be reasonably sold or delivered due to delays caused by failed delivery or lack of customer response, this may reduce or remove the refundable amount.
Healthy Arrival Guarantee
We carefully inspect and prepare every plant before delivery.
If a plant arrives significantly damaged due to transport, the customer must contact us within 48 hours after delivery with the order number, photos of the whole plant, close-up photos of the issue, photos of the container, and photos of any damaged packaging.
After reviewing the case, we may offer a replacement, partial refund, return, care advice or another suitable solution depending on the situation.
This guarantee applies to visible delivery damage or significant quality issues present at delivery.
This guarantee does not cover damage caused after delivery by lack of watering, delayed unpacking, incorrect storage, planting mistakes, unsuitable location, frost, heat, wind, animals, pests, weather exposure or other conditions outside our control.
Returns & quality complaints
Because plants are living products, visible delivery damage or quality issues must be reported within 48 hours after delivery.
The customer should provide the order number, photos of the whole plant, close-up photos of the issue, photos of the container, photos of the packaging if it was damaged, and a short description of the problem.
Visible complaints reported later may be refused if we can no longer reasonably determine whether the issue was already present at delivery or caused later by handling, watering, storage, weather or planting conditions.
Plants must not be returned without contacting us first. Unapproved returns cannot be accepted.
We do not accept returns simply because the product is no longer needed, the customer changed their mind, or the plant does not fit the planned location, as long as the delivered product corresponds to the order.
Customers should check the product description, size, plant form, mature size and delivery information carefully before ordering. If the customer is unsure whether a plant is suitable for their project, they should contact us before placing the order.
Approved returns and refunds
If a return is approved, the plant must be kept in good condition until collection or return.
Plants that have been planted, dried out, damaged, heavily pruned or otherwise changed after delivery may not be eligible for return or refund.
After an approved return has been received and inspected, we aim to refund the eligible amount using the original payment method within 14 days, and no later than 30 days.
Delivery fees, failed delivery fees, handling fees, storage fees or loss in plant value may be deducted from the refund where applicable.
Liability
We are not liable for damage caused by incorrect handling, delayed unpacking, lack of watering, unsuitable storage, unsuitable planting conditions, extreme weather, pests, animals, or other circumstances outside our control after delivery.
For living plants, successful establishment also depends on planting location, soil, watering, weather and later care.
To the extent permitted by law, our liability is limited to the value of the purchased products affected by the issue.
Nothing in these Terms excludes or limits liability where such exclusion or limitation would not be permitted by mandatory law.
Events beyond our control
We are not responsible for delays or failure to perform caused by circumstances beyond our reasonable control.
This may include severe weather, frost, heat, storms, natural disasters, transport disruptions, strikes, labour shortages, supplier delays, plant health restrictions, government actions, technical failures, import or border delays, or other events outside our reasonable control.
If such an event affects an order, we will try to inform the customer and find a reasonable solution where possible.
Intellectual property
All content on this website, including text, images, logos, graphics, icons, layout and design elements, remains the property of Alierd GmbH or the respective rights holder unless otherwise stated.
Website content may not be copied, reproduced, distributed or used for commercial purposes without our prior written permission.
Privacy
Detailed information regarding the processing of personal data can be found in our Privacy Policy.
We use customer information to process orders, handle delivery, communicate with customers, provide customer support, process payments, manage complaints and comply with legal obligations.
Applicable law
These Terms & Conditions are governed by Swiss law, unless mandatory legal rules provide otherwise.
The version of these Terms & Conditions available on the website at the time of ordering applies to the order.
We may update these Terms & Conditions from time to time.
